Section 1: Mandatory Documentation
The following documents are required to rent a car from Hertz Saudi Arabia and must be presented at the counter:
- The renter must be at least 21 years old.
- A valid Saudi ID, Iqama, or passport.
- A valid driving license issued at least one year prior to the rental date.
- A valid international driving permit, if applicable, for customers on a visit visa.
- A credit card in the renter’s name for deposit purposes.
Section 2: Delivery, Extension, Return, and Replacement
- The minimum rental period is one day (24 hours) with a maximum grace period of two hours from the end of the agreed rental period. If the car is returned after this period, Hertz reserves the right to charge additional daily rates according to the regulations of the Saudi Ministry of Transport, including any selected option fees for each day.
- The customer must notify Hertz in advance of any desired rental extension. If the vehicle is not returned by the due date and Hertz is not informed of an extension, the contract will be automatically renewed, and fees will be charged to the available credit card.
- The rental agreement remains valid until the vehicle is returned to the agreed delivery location.
- By accepting the vehicle, the renter confirms that the vehicle is in the same condition as described in the vehicle inspection report and accepts full responsibility for any additional damage or loss, regardless of cause. The renter is fully responsible for the vehicle until it is returned and checked in by an authorized representative, as confirmed in writing by Hertz.
- The renter agrees to return the vehicle along with all documents and accessories (such as the spare tire and tool kit) in the same condition received, at the location, date, and time specified in the contract.
- Hertz reserves the right to repossess the vehicle at any time if it is used in a manner that violates the contract or if the renter fails to meet their financial obligations to Hertz.
- If the renter returns the vehicle outside business hours, they must follow Hertz’s after-hours return policy for that location. In all cases, the renter is responsible for the vehicle until the location reopens, and Hertz checks in the vehicle.
- If Hertz approves a vehicle return to a location different from the rental location or agrees to pick it up, the renter remains responsible until Hertz receives the vehicle. The renter must obtain documentation confirming the return.
- Hertz is not responsible for any loss or damage to personal belongings left in the vehicle during or after the rental period. The renter bears full responsibility for such items throughout the rental term.
- A rental vehicle may require replacement due to sale, maintenance, accidents, etc. In such cases, the renter must return the vehicle upon request by Hertz. Hertz does not guarantee re-issuing the same vehicle. If delays in vehicle return hinder scheduled maintenance, causing financial obligations or penalties, the renter bears the cost.
- If the requested vehicle is unavailable, Hertz may offer a temporary upgrade. Once the originally booked vehicle becomes available, Hertz will contact the renter to exchange it. If the renter does not comply after three attempts, charges for the upgraded vehicle will apply from the availability date of the originally requested vehicle.
- Early termination of monthly contracts will result in higher fees calculated based on standard daily rates for actual days used.
- If the renter fails to return the vehicle on time, does not settle charges by the agreed date, or uses the car in violation of the agreement, Hertz reserves the right to:
• Report the vehicle as stolen to the police
• Repossess the vehicle without prior notice
• File a legal claim for unpaid charges
• Charge late fees as per the rental terms
Section 3: Personal Data
- The renter authorizes Hertz to share their personal information with relevant authorities such as police, traffic departments, criminal investigation units, and other official entities.
Section 4: Pricing and Modifications
- Rates may change if the reservation is modified after confirmation. If the renter modifies the rental duration (extension or reduction), Hertz reserves the right to adjust the pricing accordingly.
Section 5: Usage Conditions
The renter must take care of the vehicle and is prohibited from:
- Transporting people or goods for a fee unless written approval is obtained (e.g., trucks/vans).
- Exceeding the vehicle’s designed passenger capacity.
- Carrying items or substances that could damage the vehicle’s condition or prevent its re-rental.
- Pushing or towing any vehicle, trailer, or object.
- Participating in races, tests, competitions, or illegal activities.
- Driving off-road.
- Driving under the influence of alcohol, drugs, sedatives, or any impairing substances.
- Subleasing the vehicle.
- Driving outside the country without prior written approval and necessary documents.
- Entering restricted zones as identified by Hertz.
- The renter agrees to:
• Accept full legal responsibility for violations
• Cover all costs and expenses
• Compensate Hertz for any losses or damages resulting from violations of these terms
Section 6: Insurance Policy
- The insurance policy is subject to contractual terms.
- If authorized to drive outside Saudi Arabia, the renter must purchase additional insurance for out-of-country use. This covers only accident-related damages and not other expenses. Claims require full documentation, and the renter bears all transport or related costs.
Section 7: Damage, Injury, or Theft - In case of damage, injury, or theft, Saudi regulations apply.
- The renter is fully responsible for damage caused by fuel contamination, flood water, sea/saltwater exposure, desert rocks, dunes, or off-road driving.
- In the event of an accident (with or without vehicle damage), injuries, or theft, the renter must immediately report it to Hertz and the authorities, provide required documents, and submit a copy of the official report. Failure to do so may void insurance coverage, making the renter liable for all losses.
- The renter must not admit liability or compromise insurance validity. Otherwise, they are solely liable for third-party claims.
- The renter agrees to fully compensate Hertz if the insurance company rejects a claim due to renter negligence or legal actions against Hertz.
- The renter must cooperate with Hertz and insurers in all legal matters related to accidents or theft.
- If the official accident report fails to assign third-party responsibility, the renter bears all costs and excess charges based on the selected insurance coverage.
- Glass and tire damage is not covered by insurance; the renter is responsible for replacement costs.
- No repairs may be made without Hertz’s prior written approval; otherwise, the renter will bear full restoration costs.
- Insurance may be cancelled for violation of policy terms. In such cases, the renter will be liable for all resulting costs and losses.
Section 8: Governing Law and Jurisdiction
- This agreement is governed by the laws and regulations of the Kingdom of Saudi Arabia. Any disputes will be referred to the competent authority.
Section 9: Fees
- Hertz may change its policies or rates without notice. These are general informational policies and do not waive any of Hertz’s rights.
- Monthly rentals include limited mileage. Extra kilometers are charged based on the vehicle category. Refer to the contract for details.
- Any traffic or municipal violations during the rental period will be charged to the renter or the renter’s company.
- A service fee applies to each violation. If a violation results in vehicle impoundment, Hertz will pay the fine and recover the cost from the renter’s credit card.
- Administrative fees apply where Hertz provides additional customer assistance (e.g., police reports, translation, DUI, vehicle release).
- A cleaning fee applies if the vehicle is returned in a condition requiring special cleaning.
- Roadside assistance for towing due to negligence will incur additional charges.
- The renter must pay all charges on time. If the contract is renewed or the vehicle is not returned, new charges apply at the current rates.
- The renter authorizes Hertz to charge the credit card for rental fees and any additional charges (e.g., fines, fuel, damages, tolls).
Section 10: Payment, Cancellation, and No-Show
- A credit card in the renter’s name is mandatory.
- Online payments are accepted via Visa and MasterCard in SAR.
- Hertz applies cancellation/no-show fees per company policy and in compliance with regulations.
- Reservations can be cancelled 24 hours before the pickup time via:
• Saudi Arabia: 8002440288
• Email: customerrelations@hertz.com.sa - Credit card and personal information are not stored, sold, shared, or rented, in compliance with data protection laws.
Section 11: Refunds
- Refunds for cancelled bookings are processed to the original credit card within 30 days.
- Refund claims must be submitted within 30 days of the scheduled pickup.
- Other refunds are processed within 30 days after contract closure. Unpaid dues will be settled before refunds.
- If a refund cannot be processed due to an invalid credit card, a claim must be submitted within 6 months of vehicle return.
- No refunds apply for early returns on daily or monthly rentals.
Section 12: Indemnity
- Hertz is not liable for losses or damages unless caused by gross negligence or fraud.
- The renter agrees to indemnify and hold harmless Hertz (and affiliates, employees, agents) against any losses or claims arising from contract violations or vehicle misuse.
Section 13: Language and Interpretation
- These terms and conditions are drafted in Arabic. In the event of discrepancies between versions, the Arabic text shall prevail for interpretation.
